Plain sight certainly applies to who is driving a car. How else would cops issue tickets? Or stop a suspect? To say an expectation of privacy as to your identity prevents you from getting a red light ticket first make sense. At least not in NY where I'm a prosecutor.

There was a case in my county last year where a guy was videotaping a woman in her bathroom. The key difference was that he ha to manipulate the position of the camera to see in. If she had been parading in front of an open window, things likely would have gone differently.
