Child Support Credit Card Theft!! EPPICard USERS**UPDATE**

Wow  it's nice to know that I'm not the only one mad at CS. Mine("sperm donor" is what I'll be calling him from now on) owes close to 6 digits in arrears :furious: and they seem to do nothing about it. I 've always give them updated info on where he lives or moved to. That money could have sent my DD to college. It also makes me mad that my daughter can mail him pictures and letters and CS mail (so they say) gets rejected from the post office of the same addy my daughter used. Is there anyone out there on the Disboards world work for CS? Maybe they could help us with what we need to do next. Or maybe we can start a new thread. Sorry for being :offtopic: getting off the the soapbox now.

As the custodial parent if we didn't support our kids we'd be brought up on charges for neglect. :headache:

THANK YOU! I have been yelling this for 4 years to CS. If I did not feed her, cloth her, house her or get her medical care she would be gone and I would be in jail. Glad I am not the only one who thinks this way..

I cannot believe what I am reading! My DH pays his child support RELIGIOUSLY even though there is no support order. They just agreed on $300 every month. After a few years, Exwife decided she wanted more so they upped it to $400 by mututal agreement. Now she has decided to turn DH over to the State of Oregon (after 12 years!!!) to get a permanent order and get it raised again. Our attorney said it would definitely be more than we are paying. How can that be? My DH is a teacher not a brain surgeon! I just dont get how some men get ordered to pay $23 a week and we are gonna have to pay probably somewhere in the neighborhood of $500 every month.

What do your ex - DHs do to only pay $23 a week?

Also I have a question for thise of you more in the know than me.......when they calculate our new order, will they take into account my salary as well or only his and the mother's?

We should start a "support" group for each other (pun intended!). Glad to know I'm not the only one out there with this problem. It kills me that he gets visitation but can't pay support. They give him every chance in the world to visit with DS, but if I did even one of the things he did they would take DS from me in a flash! :sad2: I just don't get it.

I was never married to my donor...but he just doesn't work! Yup a 28 yr old man-child that doesn't work and lives off his mom. I know in NY the support is 17% of your salary for one child. Here is the site for your state. It should have a lot of answers for you!

Unfortunately when I waste my days in court, the only people I see getting slammed by the system are the GOOD ones. I think we need a serious overhaul in our family court systems.

In most states, your salary is exempt from your husband's child support obligation. However, if his wages are garnished, that can obviously affect your bottom line. Make sure he has clear documentation of those 12 years of payments or he could be on the hook for significant arrears...even if the ex states that she received it, she could say that money was only a "gift" and not count toward his support obligation. If this happens, get a lawyer YESTERDAY.

The state has many remedies to obtain funds including drivers license suspension, wage garnishment, and some can even obtain liens on property -- even joint-owned property.

Just FYI, I am another parent who never gets child support. I am sure the arrears are over $50K by now. The system only seems to work for the deadbeats, in my opinion.

Good luck.

I can honestly say that my DH pays religiously and there has been no court orders. We pay $125 a week for one child. The Skank likes to pull the " I'm gonna take you to court so I can get more" card and he doesn't deal with it. She yanks visitation with him and turns the kids on him. We have been married for 8 years and I think he has seen them about a dozen times but he still pays. I think she is a deadbeat mom. She brings various men in and out of the home and on top of that she only works 2 days a week....AT THE DOLLAR STORE!!! ***? Me and my DH go to school full time, work full time and raise 3 of our own children. *** can't this woman get a darn job? We have told her time and time again that if she takes us to court she will most likely to get less:confused: I don't know. I am sorry for my rant. I am sure you guys understand. Its sad though that the mother just doesn't get it:furious:

Could he still be in arrears even if they had no order for child support? All our paperwork was lost in Hurricane Katrina. I have bank statement showing cancelled checks for the past 3 years but nothing before. Always I write on the check "FOR CHILD SUPPORT" and the month and year. They didnt have an order, she said she didnt want CS when they got divorced. Shortly thereafter she changed her mind when she couldnt find a job.

::yes:: I think it is ALL support agencies. Apparently I'm wrong for requesting that they take action against him since he NEVER makes timely payments :confused3. It isn't like he has to pay a million freakin dollars! His payments are $50/week!

yeah, I wish mine paid too!! MA won't do anything about it until he's over $2,000 and he's gonna be there soon. But I have to call and request that something be done and it could be paid up by then or I could go to the courthouse and send a sheriff to his house to let him know they will revoke his license if he doesn't pay up.

It all depends on the judge and what the ex states (and how believable both parties are). A new order could take effect as of the day of filing, or she could request arrears. I think your husband needs to at least consult with a lawyer. Does the ex know that you don't have documentation because of a hurricane? Would she use that against him? Does the bank have recorded info longer than the three years you have?

Other things that could come out of the hearing: he may have to pay for health insurance on top of child care and it is possible that he may have to carry life insurance with the ex and/or child as beneficiary. Both of these are actually very responsible things to do. Also, if the ex ever used public funds (welfare) to support the child, he will have to pay the state back.

Good luck.

I am the OP and it seems I opened up a can of worms LOL! I sympathize with you all! I feel like having my CS account (Eppicard account) compromised and robbed only rubbed salt in the wound! I only receive $240 a month...when it comes. He's always behind and his wages are garnished. He's 43 years old and lives at home with his parents!! His wages are garnished, so i don't get why CS cannot enforce this piddley order?!
Now I really got one for you....a few years ago when my order went up from a whopping $146 a month to $240 the state of Florida never sent the new modified order to Pennsylvania....sooo for months I argued with PA that the order was changed and that I got a letter saying so, yet I was still only receiving the old amount and the rest was "frozen". All, because PA had not received an official order from Florida. Finally I went to my own computer, logged into the Florida Child Support website...found my order (public knowledge) printed it off and brought it to my CS department. I finally got someone in charge to accept that as a copy of the order! Can you imagine that Florida has someone in charge of putting child support orders and other types of information on a county website, but no one is able to put the same order in an envelope with a stamp and send it to PA? I actually went into my CS offices and showed THEM how to access the internet site I got the information from! LOL! Interstate cases STINK!!
**I am glad no one else with an Eppicard got scammed by the email, but I just found out that their actual data base was compromised as well, so if you have this card, PLease cancel it and go to direct deposit....***

LOL Liz! No, you didnt open up a can of worms. I just think that everyone has something to vent about sometimes.::yes:: This thing with DHs ex just came up in the past few weeks so I was glad to have someone to ask these questions to. I dont know anyone who gets or pays CS except us. (my dad never did!) I am so sorry about your card. That is like taking food stamps from an old lady, IMO. Fast track to he!! is all that will get you! What is the world coming to?

A coworker of mine had her actual card stolen and money taken from her account. When I login to the NY C/S site (to see if a payment was ever made or if I just accrued MORE arrears) there is a huge warning:

Yes...I'm from Indiana and just logged on a couple days ago to get my balance and saw the same warning.
OP, I really appreciate you posting this. I'm infamous for losing any card I have and, though I have yet to lose the EPPIcard, this WILL be a great help WHEN that happens;)

I have an ex who is the sperm provider for my oldest two dds. We were divorced when they were practically babies (separated before birth of the second). After parenting classes and supervised visitation (anger management issues), he was granted visitation. We moved out of state (new husband) and he has seen the children ONCE in ten years. His choice.

He makes a GREAT salary, and is court ordered to pay child support. He is currently six figures in arreage (my estimation). One of my dds is now 18, the other is 16 and has multiple chronic medical issues including epilepsy, asthma and a cardiac defect. Her medical bills are horrendous (we have 80/20 coverage) and if my dh didn't pay them I think we would be living in a cardboard box.

The state of Maryland (where the jurisdiction lies) has been little to no help and we have been back to court several times and headed there again (of course I have to pay a lawyer) at his request to have child support discontinued for dd18 (I guess that would be the support he hasnt been paying).

I am so angry that he would have the nerve to drag me to court to discontinue the child support he is in arreage for :furious:

Just wanted to :grouphug: for everyone dealing with CS issues and what the OP had to deal with. I could go on for days about how useless the LA County (now State of California or whatever) child support system is. :furious:

wow I didn't realize how many of us on this board deal with the same CS stuff. My donor is 30K in arrears and lives in SC (i'm in NY) states don't work together, you would think they would, lol......... My donor doesn't work either but I managed to get his social security and disablity. I'm certain he is working under the table..... has anyone gotten their donor's stimulas check? Just curious if the government was smart enough to spend that money where it should be going.... to the kids of these deadbeat parents.

just curious

I did not get my ex's stimulus check, but I did get about $1500 from his tax return about 3 years ago, when he was reeeaaalllly in arrears. It saved his but actually, because he was about to get his licence taken if he didn't pay something! I cannot stand how states don't work together....I know SC is bad. My ex lived there first and I was in PA. it took 9 months to get the support started and then they would not award me the arrears! he then moved to FLO where they awarded me the arrears SC did not....BUT it took another 5 months for the order to transfer states! Ugh!

Sorry to hear you were scammed. It's disgusting. :furious: I had the EPPIcard also, received one child support payment on it, decided I didn't like it and switched to Direct Deposit. I'm in Virginia and this year DCSE has decided that we, the custodial parent, need to be charged a fee. If they collect more than $250 for you in a year you're charged a $25 or $50 fee, I can't remember which right now. What r they thinking?
