I listed my timeshare on sellmytimesharenow.com and I sold through another site. They said they would refund my money (they have a listing fee....yeah, I know I was stupid) and their contract says they will give it back if you sell for the same price somewhere else. Anyone do this and get the money back. I'm concerned they will not honor their contract. Anyone know anything that might help?

Did you pay by credit card? If so, contact your credit card company as soon as possible.

If you paid by check, call your bank and see if anything can be done. Probably not though unless fraud is involved.

I paid by credit card.....but right now, it's not fraud. I have to wait for the proof of sale. I just hope that's not so I have no recourse.

True ... but given this company's track record ... if you are near the 60-day limit I would dispute the charge with the credit card company.

Just tell the truth ... and show them where it says in their terms that they will refund the money.

If you go beyond the 60 days you might not have any recourse.

How bad is their track record?

Well... you had a bad experience with them from what I gather in your recent try to sell with them.

Others on these boards have also posted not so great experiences.

And googling the company name and going to the BetterBusinessBureau they have a C+ rating ... generally, C+ is not good ... could be worse but usually complaints finally taken to the BBB have had a hard road getting there.

They have had 53 complaints filed against them. Why take it to that level if you can deal with it now with your cc company? If you give the clear facts I think even your cc will be happy to help you in this instance. On the BBB the complaint details give tales of them not refunding $998 listing fees. If you are talking that much money I would be calling my cc tonight.

I thought you mentioned that you may have dropped the price a few dollars to sell it quickly? If so, does that really fulfill the contract of selling it for the same price elsewhere? I don't know what their contracts look like but I'm going to guess they go a lot for strictness and technicalities.

I made sureI dropped it with them first AND made sure it was updated on the website first. Amazingly even with it listed so low....I haven't gotten and offer from them! A a higher price on another site I got offers within hours! That's scary! The other two sites listed it as pending(the one that sold) and the other one removed it immediately.

By the way....great memory!

I want to follow procedure because that's just who I am.....going through the credit company now is kind of underhanded( I think?) because technically they haven't said no yet. I looked at that site and did see a few comments back from the company....so I'm hoping they follow through with this. No one here so far has had the same thing happen....so I'll keep my fingers crossed. Most of the complaints are from 2009.... Maybe they have figured things out?

I would put the dispute on the table ASAP it is not underhanded if you are due a refund. I have done this on several occasions over many years and the CC company worked with me. I would explain I am waiting for a refund and if I do not get it I am disputing the charge. See what your CC company has to say as far as time limits ect..... It does not put a "bad" mark on the company you are disputing they will simply receive a letter saying you are disputing the charge and it is up to them to PROVE the charge is valid.

Actually, it is recorded as a chargeback against the merchant, regardless or who wins the dispute. It also creates a large amount of work for the merchant who must prepare a statement and gather all documentation to forward to their card processing company. The card processor then must forward a formal rebuttal to the originating card company. The funds are also withdrawn from the merchant's account, pending a decision from the originating card company, which can take up to six weeks.

I understand what you are saying. However, if anyone is being underhanded here it's them. They tried to get you to accept an offer that was too low and convince you that was the best, right? And then you sell within hours somewhere else for much higher. There's a reason no one wants to deal with them in the first place and a reason why they couldn't sell your contract.

I'm willing to bet those who complained to the BBB exhausted all other means of getting their money back before taking the BBB route. And ultimately didn't see their refund for a very very logn time after they started the process with the BBB.

Protect yourself now and file with your credit card company. There is nothing wrong with doing so.

I am finally closing on a purchase with a seller from SellMyTimeShareNow.com

They have very high closing costs --- over a $1000 on any contract size and very high deposits --- they asked me for $3000 by credit card. They force you to use Timeshare Closing Services (TCS).

My first "round" with them, they kept lying to me about ROFR is taking a long time because Disney is understaffed or someone at Disney has family problems. I went through a double ROFR that lasted almost 3 months before Disney did ROFR my SSR contract. The reason I went with them was because they had an unbelievably low 400 point SSR contract at $50 pp ASKING !! Because it was stripped I got a contract for $47.50, which was ROFRed.

I also was afraid that SMTN would give me a hard time on refunding my deposit of $3000 AND hit me with a large fee to boot.

So, I went with a 160 pt SSR contract that was the best they had at the time. I have passed ROFR and sent my check and paperwork back for closing.
