ROFR and UY
With all the talk of DVD beginning to ROFR at a higher rate than in the past, I was wondering if DVD can change the UY of the contract? Let's say I'm purchasing a contract has a UY of Feb and DVD has a waiting list for June.
Can DVD ROFR my contract and change it's use year to satisfy the June waitlist? And as far as ROFR goes, I would be willing to say that a stripped contract has a better chance of passing ROFR than a loaded one because DVD couldn't sell the points until there are points available. I haven't done any research but just thinking. ![]() John |

DVD cannot change the UY of a contract as it is the UY is declared at the time of the unit declaration. A contract is just part of a unit so they would have to change all the contract of the unit to be able to do this. Highly improbable!
