Should Drew Peterson get a new trial?
His current lawyers are fighting for a new trial claiming that his lead attorney, Joel Brodsky, botched the case on purpose. They say that Brodsky called Kathleen's divorce attorney, Harry Smith, to the stand knowing full well that it would convince the jury of his guilt. They say that Brodsky had a much better chance of financial gain with a guilty verdict.

Appellate attorneys are very adept at creating appellate issues. Most of the time appeals courts don't fall for it. Unfortunately taxpayers foot the bill for far too many frivolous appeal attempts.
We absolutely don't want to be incarcerating innocent and want to have a solid appellate process. IMO this attempt will get tossed. It really steams me up all the resources spent on appeals arising out of pleas, which by rules have no right to automatic appeal, strictly by leave to do so. Most of these don't reach an actual appeal, but the money spent before the door closes is sickening. |
