Letter to say hotel description wrong - can I cancel?
This is a little
but does effect our Disney holiday so hoping someone can offer some advice.We booked to go to Turkey next May with my parents. A couple of months after booking our friends announced they are getting married in Orlando next October so guess what!!! We had to say yes and are now off to Orlando for the fourth year in a row - its a hard life!!! My parents then agreed to come with us so we are all booked into Saratoga Springs. I budgeted and realised I could afford to do both holidays (although it is a little tight!) Yesterday we received a letter from Thomas Cook to say that the hotel we booked in Turkey is not as advertised and the refurbishments and completion of an Aquapark will not be finished when we go. Having given it some thought we are all of the opinion that the Turkey holiday is not now necessary with a holiday to Orlando at the end of the year and wondered the fact the hotel is not as advertised is reason enough for them to refund our deposit? My Dad said he could actually use the money to book his flights if they say we have to use it at Thomas Cooks on another holiday? Does anyone have any experience of this and where we might stand. Just want to be as clued up as possible when we go into Cooks tomorrow. TIA Sara x

I would think that you should be able to cancel and get a full refund. My argument would be that if you'd known at the time of booking the holiday that the refurbishments and the Aquapark were not going to be completed by the time you arrived, then you wouldn't have booked it in the first place!

I agree with Catherine. Your argument is that the selling point of the hotel will not be available to you therefore you no longer wish to go. Did Thomas cook offer to give you a refund or did they offer to look for alternatives for you with similar features to your original hotel? Feel free to PM me should you need any more advice, I have experience with this type of thing so don't mind helping you out :-)
