An aunt goes to her 8 y/o nephew's b'day party four years ago. Nephew is excited to see her and jumps into her arms telling her how much he loves her. Her wrist breaks when they tumble to the floor. Four years late and she is suing her nephew for $127,00!

Aunt has struggled with the broken wrist, apparently.
"I live in Manhattan in a third-floor walk-up so it has been very difficult," she said. "And we all know how crowded it is in Manhattan. I was at a party recently, and it was difficult to hold my hors d’oeuvre plate."

Really?
Oh, and the nephew lost his mom last year on top of everything else.

This sounds so fake. It's difficult to hold her hor d'oeuvre plate? Are you kidding me?? I know people sue for all kinds of things, but sheesh! Safe to say she won't be getting aunt of the year award.

Sadly it is most likely true. Not sure sbout NY courts, but here in RI it would be unlikely she would be successful

I kind of thought it might be one of those things where she's trying to get the homeowner's insurance or some liability umbrella policy to pay. But her quotes to the news sources make her sound like a real witch.

Not fake at all sadly.

Thankfully they already turned it over to the jury who found the nephew at 0 fault and awarded the aunt nothing.

Great to read. Unfortunately, that young boy will have already suffered at the hands of his so called Aunt.

Yeah. Looks like they didn't make him come into court for sentencing which is great. It has been all over the news here in NYC and nobody can believe it actually made it to the jury.

There was so much about it that made me loose faith in humanity for a moment. The fact she is still wearing a brace 4 years later is laughable. Also her whole thing was she is having issues living in the city because of this injury. I live here too and have an old wrist injury that flairs up from time to time. I've never once thought it makes it more difficult to live in the city or climb my apartment stairs. Heaven forbid you have to hold your hors d’oeuvr plate with your other hand!

!

Wait, was someone "sentenced" in this case? Hopefully the aunt for filing a frivolous lawsuit.

I suppose you mean the boy wasn't in court when the jury ruled against the aunt.

You're probably not going to win a lawsuit like that against an 8 year old kid unless it's willful misconduct.

I was really surprised that he was jumping up to tell her he loved her. I wonder how he feels about her now.

Hopefully this boy was too young to be really stressed about such a frivolous lawsuit.

Geez. What a waste of time for a jury.

He'd be 12 now, right? I imagine he has had some involvement in the case.

My bet, the whole family was in this together to try and get more insurance money.

That wouldn't surprise me. Just like it wouldn't surprise me if Aunt Sue really thought this was legit and acted on her own.

My thought exactly.

I read last year about a case where a wife was suing her husband and their homeowner's insurance because he forgot to put salt on their icy sidewalk and she fell and broke something. Her basis for the suit was his "negligence". I didn't ever hear how it came out.
